A drinking and driving question...sort of...

Well, there is a member in my circle of friends who isn't quite yet 21. Anyhow, what I was wondering is, if I'm the designated driver in the group, but this particular friend happens to acquire alcohol during the night, and I get pulled over, can I, or anyone else over 21 for that matter, experience legal ramifications...such as a charge of supplying alchohol to a minor, even though there is no alcohol present, and WE didn't supply her? This person is a good friend of ours, but even if you tell her not to drink, she often has a way of sneaking drinks throughout the night. This is a particular issue at parties, where there are guests who are not so supportive of our wishes. I'd hate to exclude her from things...but...

Any advice or insight welcome.

i'm no lawyer, but i can't imagine how you - the sober driver with no alcohol in the car - could be held responsible for a passenger who, for all they know, called you for a ride because she is drunk. that would not make any sense. i think you are safe in that situation. personally, i would not worry about it at all.

Yeah, I was leaning along this line of reasoning as well, but I just wanted another's opinion. Thanks a lot.

This actually happened to me last week. I got pulled over and my drunk 19 yr. old cousin was in the passenger seat. I told the officer that I was just taking him home and that his parents were going to kill him for being out so late. The officer told me to get him home safely and then gave me a ticket for speeding. DAMN! You can't win 'em all.

Assuming your friend is over the age of eighteen, no problem for designated driver. The friend may face underage drinking charges.
