Can somebody sue you for not paying on ebay?

Don't get me wrong I have zero negative feedback on ebay but my girlfriend made a mistake bidding on some football tickets. She basically bid on 2 auctions by mistake, we paid for one and got the tickets but the seller wants us to obvisouly pay for the other auction also and he is not giving in. He threatened to sue if we don't pay. Can he actually sue us?

I do believe he can sue. However,. would it be worth his time? I doubt it. Chances are a lawyer would even advise him not to bother. Also,. how much did the tickets sell for? If they sold for over face value, he may be the one getting in trouble.

I would think now. I don't know about there, but in the most states in the US, you have 24 (or more) hours to back out of any contract after it is signed. Ebay could give you a strike for non-payment. I have one after refusing to pay after I found out that the seller ripped me off under another name (he was banned and popped up under a pseudonym).

Is the game over?

People can sue for anything if they get mad enough. More likely, he'd just give her a negative feedback, or pursue it inside ebay(I don't know the options there). Sueing is a lot of trouble and expense! Most people do it to get even, not to get money. If you don't mind the feedback, just apologize and say you made a mistake, assuming you really can't afford to pay. And can't you retract bids somehow? And who could afford to pay twice? With the price of these niche lines, we're lucky to keep the electric on.

Though in the seller's defense, I can totally see why he's pissed off and has every right to be.

Yes I agree that it is completely our fault.

The tickets were $160 for two which is above market price (and just to make matters worse the game was rained out so we have to exchange them next year for that game).

I don't know what to do. I guess we could pay hijm and then sell the tickets next year but on the other hand I don't mind getting a strike against me on ebay since this won't happen again. I am afraid he might sue thoughor at least start calling me and harass me.
