    Default Court orders Guerlain to withdraw Insolence packaging

    French beauty brand Guerlain (LVMH) has been ordered by a Paris court to cease selling its latest fragrance, Insolence, in its current bottle. Judge Claude Vallet, who deals with urgent cases at Paris's Court of First Instance, found that the packaging by Serge Mansau, composed of three half-spheres atop each other, was too similar to a design registered by Jean-Claude Cardiet of Paris firm Cardiet Design.

    Guerlain must therefore stop production of the packaging within 15 days of the judgement, dated October 20, although it has not been ordered to take existing bottles of the fragrance off the market. Guerlain representatives were unavailable to comment.

    The news is likely to have a significant impact on the iconic French brand, which was counting on its latest fragrance to appeal to new, younger consumers and to help it capture the US market. Last week, parent company LVMH cited the September launch as one of the reasons for its increase in nine-month cosmetics and fragrance sales.

    It's very strange to me that Guerlain didn't know of this thing before...maybe it was on purpose so they sell some stock for fans and for some people who will think that the frag bottle will be "discontinued" and then replaced?
    Why doesn't Guerlain just pay the artist? why didn't they know already?
    I mean, it takes months to do research for the name, bottle design, notes and all things before the fragrance launch of a scent right?
    Either it was on purpose, or someone at Guerlain will get fired!

    This will be a costly affair!

    Actually Guerlain doesn't need to withdraw the bottles that were already produced. But if further stock must be made, it will need to be in a new bottle.
    Just hope it will be a new design and not a recycled one, especially not the ugly duty free exclusives design.

    Anyway, nice to know I've got a collector item.
